1. Who you're dealing with
This website and its services are operated by AS Enterprises, trading as Bespo, a sole proprietorship based in Bengaluru, Karnataka, India. By submitting the contact form you agree to these Terms.
2. What this form does
Submitting the form starts a conversation — it is an enquiry, not a contract, and it does not oblige either of us to proceed. Any project begins only once we've agreed scope, price and timeline in a separate written agreement.
3. Your personal data (DPDP Act, 2023)
We are the Data Fiduciary; you are the Data Principal. We collect exactly what you type: your name, business name, email address, phone number, the service you select, and your message.
We use it for one purpose only — to read your enquiry and reply to you. We do not sell it, rent it, share it for marketing, profile you, or make automated decisions about you.
Your submission is delivered to our inbox by FormSubmit (formsubmit.co), a form-delivery service whose servers are located outside India. The DPDP Act permits such transfers except to countries the Central Government restricts by notification. Beyond that service and our email provider, your enquiry goes to no one — unless disclosure is required by law or a lawful authority.
We keep no separate database. Your message simply sits in our email inbox for as long as we are in touch about it, and we delete it whenever you ask.
4. Your rights, and how to use them
You may at any time ask us to show you what we hold, correct or complete it, or erase it; withdraw your consent; nominate someone to act for you; or raise a grievance. Withdrawing consent is as easy as giving it.
Email info@bespo.in — there's no charge, and we respond well within the 90 days the law allows. If our answer doesn't satisfy you, you may complain to the Data Protection Board of India. Please give accurate details and don't impersonate anyone; the Act asks that of you.
5. Security and breaches
Your submission travels over an encrypted HTTPS connection, and access to the inbox that receives it is restricted to the proprietor. If a personal data breach affects you, we will tell you without delay and report it to the Data Protection Board within 72 hours of becoming aware.
6. Age
Our services are for businesses and adults. Please don't use this form if you are under 18. Where we learn we hold a child's data without verifiable parental consent, we erase it, and we never use children's data for tracking or targeted advertising.
7. Payments, cancellation and refunds
We sell bespoke work. Every project is planned, designed, written and built from a blank page for one client, and the time we commit to it is reserved for you and cannot be resold.
The deposit secures your place in our schedule and covers the initial work we begin on receiving it. If you cancel, we retain a sum equal to the work actually performed and the costs actually committed up to the date of cancellation, determined from our records of stages completed, time spent and deliverables produced — which we will share with you on request.
Any part of your advance that exceeds that sum is refunded to you within 30 days. We do not retain money for work we have not done.
Where the delivered work matches the agreed brief, scope and revision rounds, a change of mind, a change of business direction, a decision not to launch, or subjective aesthetic preference are not in themselves grounds for a refund — they are grounds for the revision rounds your agreement provides.
None of this limits your rights where our service is genuinely deficient or not delivered. If we fail to deliver what we agreed, you keep every remedy the Consumer Protection Act, 2019 gives you, and we will resolve it fairly.
8. What we need from you
Creative work is collaborative. We depend on you supplying, promptly and in usable form, the Required Materials: copy, brand assets, logos, images and video in agreed formats; licences for content you supply; access credentials for domain, hosting, DNS, email, analytics and any existing systems; any third-party accounts, subscriptions, API keys or paid tools the scope depends on; the product, pricing and legal information for the pages we're building; and timely feedback, approvals and a single authorised point of contact.
9. If those materials don't arrive
Where a delay, limitation or shortfall in the delivered work is caused wholly or partly by your failure to provide Required Materials — or by providing them late, incomplete, inaccurate or unusable — that is the client's responsibility, not a failure of Bespo's performance. In those circumstances you expressly agree that:
- It is not a defect in our work. Dissatisfaction arising from missing or inadequate materials — placeholder content left in place, features that couldn't be connected, functionality that couldn't be enabled without the access or tools you didn't supply — is not non-performance, defective delivery or breach by us.
- It is not a ground for a refund or for withholding payment. Where the cause is the non-provision, late provision or inadequate provision of Required Materials, that is not a deficiency in our service, and so is not a basis to demand money back, raise a chargeback or cancel an invoice for work we have properly performed.
- The balance remains payable in full, pro-rated to the work performed. You remain liable for the remaining amount due, calculated on the volume and stage of work actually carried out up to that point, whether or not the project reached launch. Our reasonable records of time spent, stages completed and deliverables produced determine that amount, and we'll share them on request.
- Timelines are extended for the duration of the delay, and we aren't liable for a launch date missed for this reason.
- Re-work is chargeable. Work redone because materials arrived late, changed after sign-off or were supplied incorrectly is out of scope and billed at our prevailing rates.
- Prolonged non-response. If materials or feedback stay outstanding for 30 days despite at least two written reminders, we may suspend the project and invoice all work completed to date, immediately payable. Reactivation may need a fresh quote.
None of this applies where the shortfall is genuinely our fault — if we fail to deliver what was agreed using materials you did provide, that's on us and we'll put it right. Where you supply content, we rely on your confirmation that you hold the rights to it, and you indemnify us against claims arising from it.
10. Intellectual property
Everything on this site is the property of AS Enterprises (Bespo). Work delivered to you becomes yours on full payment, as set out in your project agreement. We keep the right to show completed work in our portfolio unless we've agreed otherwise in writing.
11. Liability
Our liability for any engagement is limited to the fees paid for that engagement. We are not liable for indirect, consequential or incidental losses arising from the use of, or inability to use, a delivered website.
12. Grievances
Our Grievance Officer is Aneesh Sridhar, Proprietor — info@bespo.in, +91 96864 30111, Mon–Sat 9:30 AM – 7:00 PM IST. We acknowledge every complaint within 48 hours and resolve it within one month. If you're not satisfied, you may approach the National Consumer Helpline (1915) or the appropriate Consumer Commission, and for data matters the Data Protection Board of India.
13. Governing law and your statutory rights
These Terms are governed by the laws of India, and disputes fall to the exclusive jurisdiction of the courts at Bengaluru, Karnataka.
Nothing in these Terms takes away any right you have under the Consumer Protection Act, 2019, the Digital Personal Data Protection Act, 2023, or any other law that cannot be contracted out of. End of Terms — you may now accept
